A psychoactive hemp derivative poses legal challenge to current THC regulations

A once-ignored hemp derivative has become the latest product to challenge federal and state cannabis restrictions. Delta-8-THC is slightly chemically different from Delta-9-THC, the primary psychoactive ingredient in cannabis, which is explicitly outlawed at the federal level under the 2018 Farm Bill. Although Delta 8 is psychoactive it is not currently illegal since it is a product of hemp, which many are interpreting as a loophole around state and federal cannabis restrictions. Recreational use of Delta 8 is growing quickly and, although legal challenges are pending, it may be the first of many similar derivatives to come.
